Labor defends AI scare campaign, says same rules apply to all

Artificial intelligence has crept into the machinery of Australian political campaigning, and this week it landed squarely in the middle of a partisan brawl. Labor has moved to defend its use of AI in campaign material after critics accused the party of running a misleading scare campaign, with the government reportedly insisting that the “same rules” apply to every party contesting an election.

The defence, reported by Yahoo News Australia, goes to the heart of a question that neither major party has properly resolved: what, if anything, should stop a political campaign from using generative tools to produce images, voices or video that blur the line between persuasion and deception. Labor’s answer, in essence, is that the rulebook is the same for everyone, and that nothing it has done sits outside the bounds already accepted across the political class.

How we got here

The context matters. Over the past two years, cheap and widely available AI tools have reshaped how campaigns are built. What once required a production budget, a studio and a week of lead time can now be generated in minutes from a text prompt. That shift has been obvious in overseas contests, where synthetic audio and video of candidates have circulated during elections in the United States, India and parts of Europe, and it has steadily seeped into Australian political communication as well.

Australian campaigns have used digitally altered imagery for years, long before generative AI arrived. Parties have cropped, colour-graded and recomposed photographs of their opponents to make them look shifty, tired or out of touch. Generative AI simply lowers the cost and raises the ceiling on what is possible, which is precisely why its arrival has sharpened an old argument rather than created an entirely new one. Labor’s “same rules” framing leans on exactly that continuity, positioning AI as the latest tool in a long tradition rather than a break from it.

The news, and the pushback

At issue is campaign content that critics say crosses from robust argument into something designed to mislead voters about an opponent’s position or character. Labor has rejected that characterisation, arguing it is operating within the same legal and conventional boundaries that apply to its rivals. The party’s position is that if the material is objectionable, then the standard that condemns it would condemn a great deal of what every side produces, and that singling out AI misses the point.

Opponents of the approach see it differently. Their concern is not that AI exists, but that voters cannot easily tell when they are looking at something synthetic, and that the speed and realism of modern tools make a misleading impression harder to correct before polling day. The worry is less about any single advertisement than about a trajectory, where each cycle normalises a little more synthetic content until audiences lose the ability to trust what they see and hear from political actors.

Both viewpoints have a reasonable claim. Labor is right that there is no bright line in law that treats AI-generated persuasion differently from any other kind, and that opponents who cry foul have themselves embraced aggressive tactics. Critics are right that “everyone does it” is a weak defence when the technology materially changes how convincing a falsehood can be, and that the absence of a rule is not the same as the presence of a principle.

The Australian stakes

This is where the local picture becomes uncomfortable. Australia has no general truth-in-political-advertising law at the federal level. South Australia and the Australian Capital Territory have long-standing provisions, and there have been repeated calls to extend something similar nationally, but federal campaigns remain largely governed by rules about authorisation and spending rather than accuracy. The Australian Electoral Commission has been candid that it polices who paid for an advertisement, not whether its claims are true.

That gap existed before AI, but generative tools widen it considerably. When a misleading claim can be dressed up as a photorealistic image or a convincing voice clip, the practical consequences of having no accuracy standard grow sharper. Australia has moved on parts of the problem, including work on mandatory guardrails for high-risk AI and a broader push to label synthetic content, yet political advertising has tended to sit awkwardly outside these conversations because of the constitutional protection afforded to political communication. Any attempt to regulate what parties can say, or how they can generate it, runs into free-speech questions that have defeated reform before.

For Australian voters, the immediate stake is trust. Trust in institutions is already fragile, and a campaign environment where synthetic content is both common and contested gives citizens one more reason to doubt everything they encounter online. For the AI industry locally, the row is a reminder that the technology’s reputation is shaped as much by how it is used in public life as by its commercial applications. Every high-profile dispute over a deepfake or an AI-assisted attack ad feeds the public mood that will eventually determine how tightly the sector is regulated.

What happens next

In the short term, expect the argument to stay rhetorical rather than legal, because there is little legal machinery to invoke. Without a federal accuracy standard, complaints about misleading AI content have nowhere obvious to go beyond the court of public opinion and the platforms that host the material. That puts social media companies and broadcasters in the uncomfortable position of de facto referees, deciding what to carry and what to label, with little consistency between them.

The longer-term pressure points are clearer. Calls for truth-in-political-advertising laws will intensify each time a dispute like this flares, and AI will feature prominently in the next wave of proposals, most likely through disclosure requirements that would force parties to label synthetic content rather than ban it outright. Whether any government, Labor included, is willing to constrain its own campaigning in an election year is another matter entirely. The “same rules” defence is comfortable precisely because the rules, as they stand, ask so little.

For now, the episode is a marker of how quickly AI has moved from novelty to normal in Australian politics, and how far the regulatory conversation still has to travel to catch up. The tools will keep improving, the campaigns will keep using them, and the question Labor has answered with “same rules” will keep being asked until someone decides the rules themselves need rewriting.
